Note to Smarter Form and Entity Hub Licensees or Clients Only

If you are a licensee or client of Smarter Form, Entity Hub, or any of our affiliated applications, please refer to your Master Services Agreement for the data privacy terms governing your use of the application or services.

Unless expressly stated otherwise in a written agreement or communication, this Privacy Policy does not apply to you.

 

1. Definitions

For the purposes of this Privacy Policy:

  • Account means a unique account created for You to access our Service or parts of our Service.
  • Affiliate means, in relation to OutSouth Technologies, LLC, any third-party application, platform, or service with which OutSouth Technologies, LLC has a commercial, marketing, or distribution relationship, including but not limited to Smarter Form and Entity Hub. For the avoidance of doubt, such entities are independent and are not owned by, controlled by, or under common control with OutSouth Technologies, LLC.
  • Application means the web-based (referred to as “Cloud Version”, or “Web Version”) and desktop-based (referred to as “Desktop Version”) software programs provided by the Company, including Smarter Form and Entity Hub, and any related platform or portal. The Application may be accessed by You through any internet-enabled or offline computer device, including desktop and mobile devices.
  • Client means any individual or legal entity authorized to access or use the Service (also referred to as a “Reviewer User”) that subscribes to the Service and acts as the data controller, determining the purposes and means of processing data submitted through the Application, and managing, reviewing, controlling, or otherwise processing such data.
  • Cookies are small files that are placed on Your computer, mobile device or any other device by a website, containing the details of Your browsing history on that website among its many uses.
  • Country refers to the United States of America.
  • Company (referred to as “the Company”, “We”, “Us”, or “Our”) refers to OutSouth Technologies, LLC, incorporated in Florida, United States of America.
  • Data means any information, content, or materials submitted, uploaded, entered, generated, or transmitted through the Application by a user, submitter, or authorized third party in connection with the creation, completion, review, or processing of forms and workflows.
  • Device means any device capable of accessing the Service, such as a computer, mobile phone, or digital tablet.
  • Licensee means any individual or entity that has been granted a valid, active license to access and use Smarter Form, Entity Hub, or any affiliated application or service, pursuant to a separate agreement (including but not limited to a Master Services Agreement or License Agreement) with the applicable service provider.
  • Service refers to the Application, the Website, or both, including all related functionality, content, and services provided by the Company.
  • Subscribed means that the Client has completed the registration process, agreed to the applicable Terms and Fees, and maintains an active, paid subscription that grants access to the Service or Application for the duration of the subscription period.
  • Terms and Conditions (also referred to as “Terms”) mean these Terms and Conditions, which form the entire agreement between You and the Company regarding Your use of the Service.
  • Third-Party Social Media Service means any service or content (including data, information, products, or services) provided by a third party that may be displayed, included, or made available through the Service.
  • You means the client or individual accessing or using the Service.
  • Usage Data means Data that is automatically collected about Your interaction with the Service, including device information, IP address, browser type, pages visited, and diagnostic data.
  • User means any individual or entity authorized to access or use the Service.
  • Website refers to the Company’s web domain, accessible by You at https://outsouthtech.com.

2. Collection and Use of Personal Data

2.1 Types of Data Collected

(A) Personal Data – Information You provide directly, including:

  • Account credentials

  • Submitted content/data via the Service

4. Children’s Privacy

  • Service is not directed to children under 13.

  • We do not knowingly collect Personal Data from children under 13 without parental consent.

The Service may contain links to third-party websites. We are not responsible for the content, privacy policies, or practices of such sites.

6. Changes to this Privacy Policy

We may update this Privacy Policy and will notify You via email or prominent notice on the Service. Changes are effective when posted.
